1. In case of any issues with your product mentioned herein, please contact cult (“We / Us / Our”) at the customer care, details of which are mentioned below.

  2. This Warranty is provided for each genuine product(s) and related accessories (as detailed below), included in the product sales package. For the sake of clarity, Warranty shall be covered in the following manner:

  1. Our liability:
  • To the extent permitted by applicable law(s), We shall not under any circumstances be liable, either expressly or impliedly, for any (i) damages or losses of any kind whatsoever resulting from or relating to corruption of, content or data or the recreation or transfer thereof even if such loss, damage, or corruption was a result of a defect in your product or accessory; and/or (ii) loss of life, injury, and/or (iii) loss of profit, use, productivity, business, contracts, revenues or anticipated savings, increased costs or expenses; and/or (iv) for any indirect, consequential or special loss or damage. Our liability under any circumstances whatsoever shall be limited to the return/repair/replacement of the concerned product in question.

  • We do not warrant that the software preinstalled on the product (or subsequent updates) will meet your requirements, work in combination with any hardware or software not provided by Us, be uninterrupted or error-free.

  • In the event of expiry of this Warranty / non-coverage under the warranty guidelines, we reserve the right to charge you (in the manner decided by Us) for the repair/replacement upon ascertainment of the defect in your product or accessory.

  • Replacements for products within the warranty period will be provided only after a diagnosis by an authorised technician or a formal assessment by Us.

  • Refunds shall not be issued for any products within or outside the warranty period, and the sole remedy available shall be repair and/or replacement (for products that are in the warranty period) in accordance with the terms prescribed herein.

  • For out-of-warranty products, any repairs related to third-party software issues, malfunctions, or the continuation of licenses provided by third-party vendors will incur charges as deemed necessary by Us.

  • The Company may, at its discretion, provide service support for discontinued products, strictly subject to spare parts availability. The Company shall have no obligation or liability if such parts are unavailable.

  • The Warranty period starts on the date mentioned on the product invoice, as evidenced by the original proof of purchase.

  • The Warranty is confined to the user/purchaser of the products and is non-transferable. This Warranty applies in India only, is provided to the original purchaser, and is non-transferable, except where mandated under applicable consumer protection laws. Warranty claims must be supported by a valid purchase invoice of the product. Warranty claims shall be rejected in case the original serial number is deleted, defaced or altered; unless the warranty card is completed and signed by the Service Centre immediately on delivery of the concerned product.

  • In order for the Warranty to be claimed, the product and its accessories shall be used in accordance with the instructions provided in the product manual (which comes along with the product) or any other information that may be available online on our website. If the product has been or is attempted to have been, without our permission, dismantled/repaired/shifted/used for experimentation or unintended purposes / kept in a hostile environment, then the warranty shall stand cancelled.

  • Any warranty claim applies only if the product is purchased or serviced through our authorised vendors.

  • During the Warranty period, we (either ourselves or through a third-party service provider) will (within a reasonable time) endeavour to remedy the defect (subject to adherence to these terms contained herein) by either repairing or replacing the defective product or accessory or the defective part (as the case may be). For the aforementioned to be effective, you shall return the defective product or accessory to Us before the Warranty period has expired. When repairing or replacing your product or accessory, we may use new or reconditioned parts or provide a refurbished replacement product or accessory, except where the use of such reconditioned parts or refurbished product or accessory is prohibited by Indian law. Replacement or refurbishment of any product/accessory is subject to approval by Us after considering all the circumstances and evaluating the evidence (as may be requested by Us on a case-by-case basis)

  • You shall note the following:

    1. In case, you need services for your product at a different location than where the product was originally delivered, the following protocol shall be followed: (i) if the new location is 1- 3 KMs away from the original location of product delivery than the warranty stays intact; and (ii) if the new location is more than 3 KMs from the original location of product delivery than all the services shall be chargeable.

    2. For cases like users of the product with weight above the prescribed limit, rat bite or usage of the product for commercial purposes (including but not limited to gyms,  professional spaces), visits and spares are chargeable in such cases, subject to the availability of spares.

    3. No repair or replacement will renew or extend the original Warranty period unless such renewal or extension is mandated by applicable laws, in which case the Warranty period is extended by the minimum time required by applicable laws.

    4. Where the product, accessory (or any parts of a product or accessory) have been replaced, the original product, parts, or accessories which were found to be defective shall be retained by Us.

    5. We shall not be liable for any loss of data stored on the product (if any data is collected). It is advisable to always back up all data, programs, applications, and content stored on your product before handing over your product for repair/replacement.

  • This Warranty shall not cover:

    • Any issues or damage due to exposure to liquid or dampness (unless the product is declared to be water-resistant under certain conditions as specified by Us), dust accumulation, excessive moisture or humidity, damage caused by exposure to extreme electromagnetic field, or extreme thermal or environmental conditions or to rapid changes in such conditions, corrosion, oxidation, spillage of food or liquid, lack of lubrication or influence from chemical products;

    • Physical damage, cracks, dents or scratches caused by external forces (including transportation damages and improper installation by an unauthorised third party) impacting the product or any part of the product, including but not limited to the cover, display, and buttons;

    • Using your product with, or connecting it to, any product, accessory, or service not manufactured, authorised, or supplied by Us or chargers, power adaptors or data cables which do not meet the required technical and safety specifications;

    • Power outages or surges capable of affecting the normal use of the product and/or any of its accessories, including voltage fluctuations outside the range of 220-240V; 

    • Other acts beyond our reasonable control, including theft;

    • Any issues or damage due to weight not supported for the product, rat bite, usage for commercial purposes, alterations and modifications, and wear and tear (including any degradation or peeling of the colour of any product);

    • Use of your product in a manner that does not comply with its intended use/manhandling of the product and non-compliance of the provisions of the product manual or as specified on our website, including but not limited to irregular / no servicing as prescribed by Us;

    • Damage or errors caused by hacking, cracking, viruses, or other malware, or by unauthorised access to services, accounts, computer systems, networks, or unauthorised upgrade to the system;

    • If your product has been opened, repaired or modified by non-authorised third parties, or repaired using unauthorised spare parts; 

    • Any third-party products, including third-party software sold in combination with Our Product, and/or

    • Reduced charging capacity of the battery resulting from its natural end of product life, or pixel defects in your product display that are within the scope of industry standards.

This Warranty may be updated from time to time at the discretion of Cult.sport or as required under applicable laws.
